General Terms and Conditions of Sale (GTCS)

Preamble

These General Terms and Conditions of Sale (hereinafter referred to as "GTCS") govern the contractual relationship between the contractor Agarawhich operates the online sales site www.agara.com, and any individual or legal entity (hereinafter referred to as "the Customer") wishing to make a purchase via the said site.

Any order validated on the site implies the Customer's unreserved acceptance of these GCS.


Article 1 - Ordering

The Customer may place an order directly on the website. All orders only become final once payment has been confirmed. The Seller reserves the right to refuse an order in the event of a previous unresolved dispute, payment incident or suspected fraud.


Article 2 - Prices, availability and delivery times

The prices shown are in euros, inclusive of all taxes.
Our company practices supplier priceswhich means that prices are subject to change at any time and without notice.

Product availability is indicated on each item sheet, but may change beyond our control, particularly due to variations in supplier stock.

Product specifications :

  • Shop items Baubiologie are available on order onlyThis can lengthen shipping times.

  • The products of Arc En Ciel Innovations are made to orderThis means a longer processing time.

Shipment times start as soon as payment has been confirmed and also depend on the availability of products in stock or in production.


Article 3 - Delivery

Deliveries are made by La Poste and DPDin France and abroad. Delivery costs and times vary according to the method chosen and the destination.

Once the parcel has been handed over to the carrier, the Seller cannot be held responsible for delays, loss or damage during transport.

The management of data by La Poste and DPD is their own responsibility. The Seller cannot be held responsible for the use they make of it.


Article 4 - Payment

Orders can only be paid for online via the StripeIt accepts all major bankcards and certain international payment methods.

Transactions are secured by SSL encryption. No banking information passes through or is stored on our site.

Responsibility for the management and security of payment data lies exclusively with Stripe.


Article 5 - Right of withdrawal and returns

In accordance with theArticle L.221-18 of the Consumer Codethe Customer has a period of 14 days from receipt of the products to exercise the right of withdrawal, with the exception of products excluded by lawsuch that :

  • Made-to-measure or made-to-order products ;

  • Textile items (clothing, sheets, bed linen, etc.) of which the packaging has been opened.

The Seller reserves the right to refuse a return if the original packaging is damaged or open, or if the product can no longer be considered as new.

Returns are at the Customer's expenseand must be carried out with acknowledgement of receipt. In the absence of proof of dispatch or receipt, the Seller declines all responsibility.


Article 6 - Retention of title clause

The products remain the property of the Seller until full payment of the price by the Customer.
From the time of delivery, the risks (loss, theft, damage) are transferred to the Customer.


Article 7 - Refunds

Products eligible for return will be reimbursed in the form of a boutique chequewhich is represented by a discount code corresponding to the amount of the returned items (excluding postage costs), to be used on a future order.


Article 8 - Product guarantee

All products benefit from the legal guarantee of conformity (Articles L.217-4 to L.217-14 of the Consumer Code) and guarantee against hidden defects (articles 1641 to 1649 of the Civil Code).

If a defect is found, the Customer must report the problem within a reasonable period of time. The Seller undertakes to replace or repair the product concerned, or to offer an equivalent credit note.


Article 9 - Liability

The Seller shall not be held liable for any damage resulting from misuse of the product purchased or negligence on the part of the Customer.

The Seller cannot be held responsible for delays or failures attributable to its partners (carriers, payment service providers).


Article 10 - Protection of personal data (RGPD)

The Seller undertakes to comply with the privacy of its Customers and to ensure protection of personal datain accordance with General Data Protection Regulation (GDPR).

Data collected :

The personal data collected is strictly necessary for :

  • order management,

  • improving the user experience,

  • customer relations.

No personal information is resold or transferred to third parties for commercial purposes.

The data is hosted securely. The Customer has access at all times to right of access, rectification, deletion, opposition and portability of its data, on simple request via our page Contact.

We accept no responsibility for the management of personal data by partners third parties involved in processing the order, in particular Stripe, La Poste and DPDeach of which is responsible for its own confidentiality policy.


Article 11 - Applicable law and jurisdiction

These General Terms and Conditions are subject to French law.
In the event of a dispute, and after an attempt at amicable resolution, jurisdiction is attributed to the French courts with territorial jurisdiction, in accordance with the rules of the Code of Civil Procedure.
